By using QR Code Generator, you agree to these Terms of Service. If you do not agree to these terms, please do not use our service.

1. Service Description

QR Code Generator provides a QR code generation service. We generate QR codes based on the information you provide and deliver them to your email address. The service is provided on an "as-is" and "as-available" basis.

2. Service "As-Is" and Disclaimer of Warranties

General Disclaimer (Subject to Consumer Rights):

To the extent permitted by applicable law, the service is provided on an "as-is" and "as-available" basis. We make reasonable efforts to ensure the service functions correctly, but:

• We do not guarantee that the service will be uninterrupted, secure, or completely error-free
• We do not guarantee that QR codes will function correctly in every possible environment or with every scanner application
• You should test QR codes before using them in production, large-scale applications, or critical use cases
• We are not responsible for errors in the data you provide or resulting QR codes based on incorrect input

For Business Users: To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Consumer Rights Protection: Nothing in these Terms excludes or limits any statutory rights you have as a consumer under applicable law, including our liability for lack of conformity of digital content or services with the contract. If you are a consumer and the service does not conform to the contract (e.g., QR codes are completely unreadable due to our technical failure), you retain all rights under consumer protection law, including the right to demand conformity, price reduction, or contract termination.

3. Limitation of Liability

Liability We Cannot Exclude or Limit:

Nothing in these Terms excludes or limits our liability for:

• Death or personal injury caused by our negligence or the negligence of our employees or agents
• Fraud or fraudulent misrepresentation
• Intentional fault or gross negligence
• Lack of conformity of digital content or services with the contract (for consumers)
• Any other liability that cannot be excluded or limited under applicable law

For Business Users: To the maximum extent permitted by law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• We shall not be liable for any loss of profits, data, use, goodwill, or other intangible losses
• Our total liability shall not exceed the amount you paid for the service
• We are not responsible for damages resulting from your use of generated QR codes
• We are not liable for errors in the data you provide or resulting QR codes based on incorrect input

These limitations apply to the fullest extent permitted by applicable law and do not affect any statutory rights that cannot be waived or limited.

4. User Responsibilities

You are solely responsible for:

• The accuracy and legality of the content you submit for QR code generation
• Testing your QR codes before use in production or commercial applications
• Ensuring your use of generated QR codes complies with all applicable laws
• Any consequences arising from the distribution or use of generated QR codes
• Maintaining the confidentiality of your email and payment information

5. Prohibited Uses

You may not use our service to:

• Generate QR codes containing illegal, harmful, or offensive content
• Create QR codes that infringe on intellectual property rights
• Distribute malware, phishing links, or other malicious content
• Engage in fraud or deceptive practices
• Violate any applicable laws or regulations

6. Right of Withdrawal (EU Consumers)

For EU consumers: Under EU Directive 2011/83/EU (Consumer Rights Directive), you have the right to withdraw from this contract within 14 days without giving any reason.

However, you expressly request that we begin the performance of services immediately. By using our service and checking the acknowledgment box during checkout, you:

• Request immediate performance of the service (QR code generation and delivery)
• Acknowledge that the contract will be fully performed once the QR code is generated and sent to your email
• Expressly agree that you will lose your right of withdrawal once the service is fully performed

Effect: Once your QR code has been generated and delivered to your email, the contract is fully performed, and your right of withdrawal expires in accordance with Article 16(m) of the Consumer Rights Directive.

If you do not wish to lose your right of withdrawal, you should not proceed with the purchase.

7. Payment and Refunds

All payments are processed through Stripe and are final. Due to the instant digital nature of our service and your express waiver of the right of withdrawal, we do not offer refunds once a QR code has been generated and delivered. If you experience technical issues that prevent delivery, please contact support at support@qr-generator.cheap.

8. User Indemnification

For Business Users: To the extent permitted by law, you agree to indemnify and hold harmless QR Code Generator from third-party claims where:

• You have uploaded illegal, infringing, or harmful content (e.g., malware, phishing links, copyright violations)
• You have violated applicable laws in your use of generated QR codes
• You have breached these Terms and such breach results in a third-party claim
• The claim arises solely from your content or actions, not from our service malfunction

This indemnification applies only to the extent permitted by law and does not cover claims arising from our negligence, intentional misconduct, or breach of contract.

9. Service Availability

We reserve the right to modify, suspend, or discontinue the service at any time without notice or liability. We do not guarantee that the service will always be available or operate without interruption.

10. Intellectual Property

While you retain ownership of the content you submit, the QR codes are generated using our service and technology. You may use the generated QR codes for any lawful purpose. We retain all rights to our service, website, and technology.

11. Third-Party Services

Our service uses third-party providers (including Stripe for payments). We are not responsible for the actions, policies, or services of these third parties. Your use of third-party services is subject to their respective terms and conditions.

12. Governing Law and Jurisdiction

These terms shall be governed by and construed in accordance with the laws of Poland.

For Business Users: Any disputes arising from these terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of Poland.

13. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. Your continued use of the service after changes constitutes acceptance of the modified terms.

14. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These terms, together with our Privacy Policy, constitute the entire agreement between you and QR Code Generator regarding the use of our service.
